Terms and Conditions

1. Introduction

This agreement governs the sale and installation of solar photovoltaic systems and is between:

• SBS Solar & Electricals (ABN 86 671 631 977), referred to as “we” or “us”;
• The customer as specified in the attached Quote, referred to as “you”.

The agreement includes these Terms and Conditions and the Quote.

2. Scope of Agreement

This agreement covers the purchase, delivery, and installation of the solar photovoltaic system (the “System”) as detailed in the Full System Design attached hereto, at the Premises specified.

3. Commencement and Termination

The agreement begins upon your acceptance of our Quote and concludes upon completion of installation and commissioning of the System, unless terminated earlier as per these terms.

4. Regulatory Compliance

We comply with relevant laws and codes, including the Australian Consumer Law and the CEC Solar Retailer Code of Conduct (if applicable).

5. Sale of the System

Subject to the conditions set forth herein, we agree to sell and you agree to purchase the System in accordance with this agreement.

6. Payment Terms

• Deposit: Payable upon acceptance of the Quote.
• Balance: Due upon delivery of the System to the Premises.

Payments may be made via bank cheque, money order, cash, debit card, credit card, or direct deposit.

7. Price Adjustment

Prices may be adjusted to reflect any increase in costs to us under certain conditions, provided such adjustments are reasonable and notified to you at least one week prior to the installation date.

8. Delivery and Installation

• We are responsible for delivering and installing the System at your Premises.
• Installation will be conducted by a CEC-Accredited Installer, adhering to CEC guidelines and standards.

9. Refunds

Refunds are applicable if:

• The System is not installed within 4 weeks past the target date and you opt to terminate the agreement;
• There is a price increase which you do not wish to accept;
• Grid Connection Approval is denied.

10. Privacy Policy

We are committed to protecting your personal information in compliance with the Privacy Act 1988 (Cth).

11. System Guarantees

We provide a five-year guarantee on workmanship and the System’s performance, subject to specific conditions outlined in these Terms and Conditions.

12. Complaint Resolution

Complaints can be lodged through the specified channels and will be handled promptly in accordance with our complaint handling procedures.

13. Amendments and Notifications

Amendments to this agreement must be in writing. Notices must be sent to the addresses specified and are deemed received under the terms outlined herein.

14. Governing Law

This agreement is governed by the laws of the state or territory where the Premises are located, and both parties submit to the jurisdiction of these courts.
